Josephine Muhaise’s practice covers commercial disputes corporate and commercial advisory. In disputes, Josephine handles mandates in banking and financial services, insurance, insolvency and recoveries and commercial contracts. In advisory work, Josephine acts for corporate entities on legal, regulatory and transactional matters, including regulatory affairs, commercial contracts, compliance and risk and legal due diligence.

Recent experience:

  • Defended the Uganda Civil Aviation Authority in a dispute challenging the appointment of the Authority’s Deputy Director General by the Minister of Works and Transport. The matter was dismissed in the Authority’s favour. ​
  • Successfully acted for a leading insurer in a landmark appeal before the Court of Appeal of Uganda which resulted in the setting aside of a prejudicial summary judgment with an exposure in the excess of USD 2 million.​
  • Acted as counsel for Root Capital Inc. in a contentious cross-border insolvency matter involving enforcement of their secured creditor rights during debtor insolvency proceedings. The court affirmed the provider’s rights and permitted enforcement.​
  • Advised a global pharmaceutical company on regulatory risks associated with its operations in Uganda and the compliance measures required to prevent/mitigate the risks. ​
  • Defended a series of suits challenging the regulator’s interests in the subject matter of the disputes impacting the completion of a major national project.​
  • Obtained the dismissal of a large insurance fraud claim brought in connection with the supply and transportation of medical supplies to regional hospitals in Uganda. ​
  • Acted in a complex dispute regarding enforcement of performance securities issued in connection with the construction of key power projects with the client exposure in the excess of USD 9 million.​
  • Represented several corporate entities in matters affecting their day-to-day operations such as regulatory compliance, intercompany arrangements, contractual disputes, employment related matters and risk management. 

Professional Qualifications

  • Advocate admitted to the High Court of Uganda.

Education

  • Makerere University: Bachelor of Laws.
  • Law Development Centre: Post-Graduate Diploma in Legal Practice (bar qualification).
